Please read these Terms of Use (“Terms”) carefully before downloading, installing, or using Nexspac Archive. By accessing or using the software, you (“User”, “Licensee”) agree to be bound by these Terms. If you do not agree, you must immediately cease using the software and uninstall it from your devices.

1. Nature of Service & Ownership

Nexspac Archiveis a proprietary data backup utility designed to monitor local directories and synchronize files directly to a user's connected Google Drive account. The software is owned, operated, and maintained by HackHunt CyberSecure LLP, located in Surat, Gujarat, India.

2. Licensing, Activation & Administration

    License Restrictions: Access to the software is granted via a license key. Each license key permits activation on a specified, limited number of unique devices simultaneously, as dictated by your purchased plan.

    Validation Mechanism: To enforce licensing limits, the software generates a unique machine fingerprint (using hashed hardware components like motherboard, CPU, and MAC address). The software periodically connects to our licensing server in the background to validate the license status and verify that the machine fingerprint matches the registered device.

    Account Security & Device Management: You can identify and manage your active devices via your user portal using the designated “Machine Name.” You are responsible for maintaining the confidentiality of your account credentials.

3. Acceptable Use & Account Suspension

Users agree not to use Nexspac Archive to:

  • • Back up, store, or transmit any data that violates local, national, or international laws.
  • • Reverse-engineer, decompile, bypass, or attempt to extract the source code or cryptographic licensing mechanisms (including device fingerprinting) of the application.
  • • Interfere with or disrupt the integrity or performance of the software.
Account Suspension & Deactivation:If a license is shared, distributed, or used in violation of these terms (including attempts to bypass hardware activation limits or tamper with the validation mechanism), we reserve the absolute right to instantly deactivate, suspend, or revoke the activation status of the license without refund.

4. Data Ownership & Intellectual Property

Your Data

You retain absolute ownership of all files and folders you choose to back up. Because our software facilitates a direct transfer from your local machine to your Google Drive, we do not possess, store, or claim any intellectual property rights over your backed-up files.

Our Platform

All rights, title, and interest in and to Nexspac Archive—including software code, user interface designs, logos, and licensing infrastructure—remain the exclusive property of HackHunt CyberSecure LLP.

5. Subscription, Billing, & Payments

  • Payment Terms: Access is granted based on agreed subscription tiers or one-time license purchases. All fees are non-refundable unless specifically outlined in a separate commercial agreement.

  • Tax Compliance: All fees are subject to applicable Indian taxes, including Goods and Services Tax (GST), which will be detailed on official invoices.

6. Termination

    Termination by User: You may stop using the application at any time. You can deactivate specific devices to free up your license limits via your account portal. To permanently delete your licensing account, you must contact support.

    Termination by Company: We reserve the right to suspend or terminate license access with prior notice if there is a material breach of these Terms or non-payment of dues.

7. Limitation of Liability & Warranties

    “As-Is” Provision: Nexspac Archive is provided on an “as-is” and “as-available” basis without warranties of any kind. We do not guarantee continuous operation, or integration compatibility if third-party cloud APIs (e.g., Google Drive) change their operational parameters.

    No Data Loss Liability: Because Nexspac Archive operates locally and does not host your files, we are not liable for any data loss, corruption, or syncing errors occurring on your local device or your Google Drive account.

    Liability Cap: To the maximum extent permitted by Indian law, our total liability for any active claim shall not exceed the amount paid by you for the software license in the 6 months preceding the event.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of these Terms or the breach thereof shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.
